Welcome to Ciano Art. These Terms & Conditions apply when you use cianoart.com, purchase artwork, request a catalogue, make an enquiry, commission artwork, or otherwise interact with Ciano Art.

By using this website or placing an order, you agree to these Terms & Conditions.

These Terms should be read together with our Privacy Policy, Returns Policy, Shipping & Delivery Policy, and Payment & Security page.

1. About Ciano Art

Ciano Art is an artist-run studio based in Cork, Ireland, offering original artworks, selected available works, commissioned pieces, and related art services.

2. Artwork Information

Ciano Art makes every reasonable effort to describe artworks accurately, including title, medium, size, price, availability and presentation.

Please note:

  • Artwork colours may appear slightly different on screen depending on device settings, lighting and display calibration.
  • Dimensions are provided as accurately as possible, but small variations may occur.
  • Images showing artworks in interiors, room mockups or lifestyle settings are for visual guidance only and may not represent exact scale unless stated.
  • Each original artwork is unique and may include texture, marks, surface variation, collage elements, raw edges or irregularities that form part of the artwork.

If exact details are important for your project, please contact Ciano Art before purchasing.

3. Availability

Artwork availability may change without notice.

An artwork is not considered reserved or sold until payment has been received or Ciano Art has confirmed a written reservation.

If two buyers enquire about the same artwork, priority will usually be given to the first buyer who completes payment or receives written confirmation of reservation.

If an artwork is purchased but is no longer available due to error, prior sale, damage or listing mistake, Ciano Art will contact you and issue a refund where appropriate.

4. Prices

All prices are listed in euro (€) unless otherwise stated.

Prices may change without notice. The price confirmed at the time of purchase applies to that order.

Unless clearly stated otherwise, artwork prices are for the artwork only and do not include:

  • stretching
  • framing
  • specialist crating
  • installation
  • customs duties
  • import taxes
  • tariffs
  • local fees
  • specialist art courier services

Free worldwide shipping applies only to eligible original artworks supplied rolled in a secure tube, as explained in the Shipping & Delivery Policy.

5. VAT and Taxes

VAT treatment will be confirmed at invoice stage where applicable.

Buyers are responsible for any customs duties, import taxes, tariffs, brokerage fees, handling charges, bank charges, currency conversion fees or local charges applied by their country, courier, payment provider or customs authority.

Ciano Art cannot control or predict these charges.

6. Payment

Ciano Art accepts secure payments through Stripe and PayPal. Bank transfer may be available for direct studio purchases or higher-value enquiries by prior agreement.

Full payment is required before available original artworks are dispatched, unless otherwise agreed in writing.

Ciano Art does not currently offer instalment plans, loans, finance agreements or buy-now-pay-later arrangements.

7. Commissions and Custom Artwork

Commissioned or custom artwork is created to an agreed brief, size, style, colour direction, subject matter or project requirement.

Unless otherwise agreed in writing:

  • a 50% upfront payment is required before work begins
  • the remaining 50% balance is due on completion
  • the artwork will not be delivered, collected or shipped until the final balance has been paid
  • commission deposits may be non-refundable once work has begun
  • timelines are estimates and may vary depending on the complexity of the work and studio schedule

Custom, commissioned, bespoke or personalised artworks are not eligible for change-of-mind returns unless they are damaged, faulty, or do not match the agreed brief.

8. Creative Control and Approval for Commissions

Ciano Art will take reasonable care to follow the agreed commission brief. However, commissioned artworks are original creative works and will involve the artist’s own judgement, style and interpretation.

Minor differences in colour, texture, composition, mark-making, scale, finish or overall appearance are part of the nature of original artwork.

Where progress images or approval stages are offered, they are intended to guide the process. Excessive revisions, major changes to the brief, or changes requested after work has begun may result in additional charges or an extended timeline.

9. Shipping and Delivery

Shipping and delivery are handled in accordance with the Shipping & Delivery Policy.

Rolled original artworks are usually shipped in a secure tube. Stretched, framed, crated or specially prepared works may require additional cost and delivery arrangements.

Delivery times are estimates only and may be affected by customs, courier delays, weather, holidays, strikes, incorrect address details or other circumstances outside Ciano Art’s control.

Risk of loss or damage generally remains with Ciano Art until the artwork is delivered to the address provided, unless otherwise agreed. If a buyer provides an incorrect address, refuses delivery, fails to pay customs charges, or fails to collect the artwork, the buyer may be responsible for additional costs.

10. Returns and Cancellations

Returns and cancellations are handled in accordance with the Returns Policy.

For standard online purchases, buyers may have a right to cancel within 14 days of receiving the artwork, subject to applicable law and return conditions. Custom, commissioned, personalised, stretched, framed or specially prepared works may be excluded from change-of-mind returns.

Irish consumer guidance explains that online buyers generally have a 14-day cooling-off period, but there are exceptions, including personalised products.

Nothing in these Terms affects your statutory consumer rights.

11. Intellectual Property and Copyright

All artwork, images, photographs, text, designs, logos, graphics, website content, catalogue content and other creative material remain the intellectual property of Ciano Art or the relevant rights holder unless otherwise stated.

Purchasing an original artwork does not transfer copyright, reproduction rights, licensing rights, commercial usage rights, image rights or moral rights.

Without written permission from Ciano Art, buyers may not:

  • reproduce the artwork
  • create prints, merchandise or products using the artwork
  • use artwork images for commercial advertising
  • mint or sell NFTs based on the artwork
  • license the artwork to third parties
  • alter, copy or distribute artwork images for commercial gain

Buyers may display purchased artwork privately or in a business interior, hotel, office, restaurant or similar space, provided the artwork is not reproduced commercially without permission.

12. Use of Artwork Images After Sale

Ciano Art may continue to use images of sold artworks for portfolio, archive, website, catalogue, social media, press, exhibition, marketing or promotional purposes.

If a buyer wishes their name, location or ownership details to remain private, Ciano Art will respect this unless disclosure is required by law.

13. Certificates of Authenticity

Where supplied, a Certificate of Authenticity confirms details of the artwork at the time of sale.

Certificates should be kept safely, as they may support provenance, resale, insurance or future valuation.

Ciano Art may not be able to replace lost certificates, or may require verification before issuing a replacement.

14. Installation, Framing and Handling

Unless expressly agreed in writing, Ciano Art is not responsible for installation, hanging, stretching, framing, wall suitability, structural fixings, or damage caused during handling or installation after delivery.

Professional stretching, framing and installation are recommended for large or valuable works.

Buyers, designers or installers are responsible for ensuring the artwork is suitable for the intended space, lighting, humidity, fixing method and installation conditions.

15. Interior Designers, Trade Buyers and Commercial Projects

Interior designers, stylists, architects, hospitality clients and commercial buyers are welcome to enquire about available works, commissions, room mockups and project support.

Any trade discount, designer commission, project pricing, reservation period, exclusivity, payment schedule or delivery arrangement must be agreed in writing before purchase.

Unless agreed in writing, no trade discount, commission, exclusivity or resale right is automatically included.

16. Website Use

You agree not to misuse this website, including by:

  • attempting to gain unauthorised access
  • interfering with website security or operation
  • copying website content without permission
  • uploading malicious code
  • using the website for unlawful purposes
  • scraping, reproducing or commercially exploiting content without consent

Ciano Art may restrict access to the website if misuse is suspected.

17. Links to Third-Party Websites

This website may include links to third-party websites, including social media platforms, payment providers, art platforms, delivery services or other external sites.

Ciano Art is not responsible for the content, security, availability, terms or privacy practices of third-party websites.

18. Limitation of Liability

Ciano Art is not liable for indirect, incidental, special or consequential losses, including loss of profit, business interruption, loss of opportunity, loss of data, or loss arising from use of the website, delays, customs issues, third-party services, courier failures or installation problems, except where liability cannot be excluded by law.

Nothing in these Terms excludes or limits liability for fraud, death or personal injury caused by negligence, or any rights that cannot be excluded under applicable consumer law.

19. Force Majeure

Ciano Art is not responsible for delays or failure to perform obligations caused by events outside reasonable control, including courier disruption, customs delays, natural disasters, strikes, war, pandemic, fire, flood, power outages, supplier issues, technical failures or government action.

20. Changes to These Terms

Ciano Art may update these Terms & Conditions from time to time. The latest version will be available on this website.

The Terms in place at the time of purchase will apply to that purchase unless a change is required by law.

21. Governing Law

These Terms & Conditions are governed by the laws of Ireland.

If a dispute arises, both parties will first try to resolve it informally by contacting each other in good faith.

Nothing in this section affects any mandatory consumer rights or protections available under applicable law.
